the client currently has a sql2014 cluster window 2012
and wants to add a sql2008 r2 instance for some legacy

No. You can add a database on SQL 2014 in R2 compatability mode, but not a SQL 2008 R2 instance.
The format for databases and logs has changed.

so what they are saying is that if you run the r2 software and install it on different drives that should work

I would not install 2008 on top of 2014. You can go forward but not reverse. You risk blowing up your 2014 install if you install 2008 on top.

this is a non critical box but the client has an app that wont work in 2014
so i offered compatibility mode but that was a turned down
I am sure that we can rebuild the 2014 if we hose it

I have never tested it to know. If you install 2008 first and then 2014, I can tell you that would work.

so the answer is to uninstall 2014 cluster
install 2008r2 cluster
install 2014 cluster

That would be the safest way to do it.
