That's a choice made by the dev team at MS.
Maybe there's something in the sql standards as well.
Bottom line is.

There's no secret here to perf tuning.
Find the slowest thing <in a group> and make it run faster. As I said earlier in profiler you can include the statement...

This seems very oversimplified, hence we can't help ;-).
There's very little to do here to solve the problem. Add the index on that field.

I preffer to use won't (in my head) instead of might.
That way it lives no place for ignoring the need of the order by in the final step.

Actually I've seen dynamic search queries takes as much as 485 ms AVG to compile. Then only 30 ms to run :-D.
I never had the chance to test against...

Trace to see the real total cost.
You can see it by statement & batches. And get the actual execution plan as well.
