If it's a default instance I believe it will use the default port. If you have a default instance and using a different port, you often need to create alias to that instance and specify the port. Not sure if that's what you did to work around it or not but that's what I've done before.

It is a default instance however but the port is not a default port.
Yes, i used the alias to resolve the connection from the publisher to the distributor and it has been working since then,

I had the same problem and the solution was to disable distributed transactions at the server level.
