In 2005/2000 and as far as I know in 2008, xp_cmdshell runs by default under the credentials of the connection it's being run from. The issue you mention is...

Try assigning the values to variables, then using the variables when you call the proc.

I'd use CLR for this. That has its own security risks, but they can be controlled/mitigated much better than xp_cmdshell.

There's a database creation date column in that table. Have you tried comparing that to sys.databases to check if they match?

If it can't find the expected file paths, it will usually put them in the default location. In that case, it won't overwrite ones in a different location.
