Semicolons are statement terminators, as such they should terminate statements, not start them. We don't start sentences in English with fullstops.

Couple things first...
DISTINCT is not a function, take the brackets out (round brackets are allowed around any column name)

Please post the revised procedure and exec plan.
Main point, make sure you are not changing parameter values in the procedure then using those parameter values in queries
