    i got it using

    and (

    (@con=0 AND YEARMONTH >=Replace(@YearMonth,'-',''))

    OR (@con<>0 AND YEARMONTH <>Replace(@YearMonth,'-',''))

    )

    Hope that it's a small row set and excellent performance is not a requirement...
