Can I use now SQL Server 2008 Evaluation in production environment? Or should I use only 2012?
Please advise.

I wouldn't use any evaluation edition in production. They're for evaluating the product, they have time limits to them.

I was clutching at straws a bit, but the only time I could consider using the trial editions in a production environment would be to show a proof of concept to an external customer.

Funny thing I saw here a few years ago. Someone was asking for urgent help because their mission critical SQL Server instance wouldn't start. They posted the error log and one of the last entries in the error log read something like 'Evaluation period has expired'

As Microsoft stopped selling SQL 2008; Is it legal using SQL 2008\2005 Evaluation?

SQL 2008 is still a licensed product. That being said, I'm certainly no expert on the complexities of licensing. Boiling it down to the simplest form, I do know that you need to pay for licensed products. You're going to want to check with your Microsoft sales and licensing people on what's legal.
